Terms of Service

1. Acceptance of Terms

By accessing and using PalVPS services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

PalVPS provides domain registration services, SSL certificate provisioning, and Microsoft 365 email solutions (collectively, the "Service"). The Service is provided to you subject to these Terms of Service.

2.1 Domain Registration

Domain registration services are provided in accordance with ICANN policies and the policies of the respective domain registry operators. You agree to comply with all applicable policies and regulations.

2.2 SSL Certificates

SSL certificate services are provided through our authorized certificate authority partners. Certificate issuance is subject to validation requirements and may take up to 72 hours for extended validation certificates.

2.3 Microsoft 365 Email

Microsoft 365 email services are provided under license from Microsoft Corporation and are subject to Microsoft's terms and conditions in addition to these terms.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us of any unauthorized use of your account

4. Payment Terms

4.1 Pricing

All prices are listed in USD unless otherwise specified. Prices are subject to change with 30 days notice. Price changes will not affect existing subscriptions until renewal.

4.2 Billing

Services are billed in advance on a monthly or annual basis, depending on your selected plan. You authorize us to charge your payment method for all fees incurred.

4.3 Refunds

Domain registrations are generally non-refundable due to the costs we incur with registries. SSL certificates and Microsoft 365 subscriptions may be refunded within 30 days of purchase if the service has not been activated.

4.4 Auto-Renewal

Services are set to auto-renew by default to prevent service interruption. You may disable auto-renewal from your account dashboard at any time before the renewal date.

5. Domain Registration Specific Terms

5.1 Domain Ownership

Upon successful registration, you become the registrant of the domain name. You retain all rights to the domain name subject to payment of renewal fees and compliance with these terms.

5.2 WHOIS Information

You must provide accurate WHOIS information as required by ICANN. False or inaccurate information may result in domain suspension or cancellation.

5.3 Domain Transfers

Domains may be transferred to another registrar 60 days after initial registration. Transfer fees may apply. We will not unreasonably withhold transfer authorization.

5.4 Domain Expiration

If a domain is not renewed before expiration, it enters a grace period (typically 30 days), then a redemption period (30-90 days with additional fees), before being released for general registration.

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Engage in phishing, spam, or fraudulent activities
• Harass, abuse, or harm others
• Impersonate any person or entity

7. Intellectual Property

The Service and its original content, features, and functionality are owned by PalVPS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, PalVPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Service Level Agreement

We strive to maintain 99.9% uptime for our services. For details on our uptime guarantee and service credits, please review our Service Level Agreement.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PalVPS operates, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
